ABOUT THE BEST LAWYERS LEGAL GUIDES

Using their peer review methodology, Best Lawyers: Ones to Watch recognises lawyers who are earlier in their careers for their outstanding professional excellence in private practice. 2024 is the inaugural edition of the Ones To Watch guide for Australia.

First published in 1983, the Best Lawyers lists are compiled based on an exhaustive peer-review evaluation. More than 113,000 industry leading lawyers are eligible to vote (from around the world), providing their evaluations on the legal abilities of other lawyers based on their specific practice areas around the world.

Lawyers are not required nor allowed to pay a fee to be listed.

ALANA KUSHNIR RECOGNISED IN ENTERTAINMENT LAW AND IP LAW

Alana’s art law practice spans a wide spectrum of expertise, including helping clients protect their creative output, diversify their income streams, negotiate multi-party public commission projects, and launch art tech platforms and marketplaces.

Her legal specialisations include:

  • Negotiating and drafting of contracts for private and public art commissions, artwork sales and licensing, gallery representation, exhibitions and photography of artworks.

  • Drafting of terms and conditions, letters of demand, policies and regulation-required statements.

  • Providing legal advice on art and creative projects, particularly those with an advanced technology focus (AI, VR, XR, Blockchain & NFTs) in areas including intellectual property, privacy and consumer law.

ENTERTAINMENT LAW DEFINITION

Although Art and Cultural Property Law is a practice category in other jurisdictions of the Best Lawyers guides, it has not yet been introduced in the Australian publications.

As defined on the Best Lawyers website by law firm Holding Redlich, lawyers in entertainment law will typically advise on issues such as the acquisition and exploitation of intellectual property rights (particularly copyright), and compliance with regulatory requirements (such as public fundraising restrictions, privacy, and consumer law issues), as well as drafting and negotiating the many contracts involved in any project, and acting in claims for infringement of rights (ranging from infringement of copyright to defamation).

Alana has worked with a variety of individuals and organisations in the art field on such legal matters, including artists, curators, collectors, galleries, museums, art fairs and art tech start ups in Australia and internationally.

Guest Work Agency is a boutique art law and advisory firm based in Melbourne, but is international in reach. It is the first dedicated art law practice in Australia, working with artists, collectors, galleries, arts organisations, art fairs and art tech start-ups.
